Terms of Use

The terms ‘you’, ‘your’, ‘yours’ and “User (s)” as used here, refer to all individuals and / or entities accessing these sites for any reason.

The terms “we” and “BIAS” as used here, refer to Bermuda Investment Advisory Services Limited, BIAS Investors (Cayman) Ltd., BIAS Asset Management Ltd., BIAS Global Portfolios, SPC, BIAS Nominees Ltd., BIAS Pension Plan Trust.

The term “BIAS Sites” as used here, refers collectively to www.biasinvestors.com, www.bias.bm, www.bias.ky, www.biasglobalportfolios.com, and any other websites that are under total or partial control of BIAS. Web applications, web tools, information, graphics, images, logos, icons, software and other site content used on BIAS Sites are collectively referred to as “BIAS site content”.

The Terms of Use set out below (referred to as the “Terms of Use”) form a binding contract between you and BIAS, and provide the terms and conditions under which you may use BIAS Sites and BIAS site content.

Please read those Terms of Use carefully. By accessing, browsing and/or using BIAS Sites, you acknowledge that you have read, understood and agreed to be legally bound by the Terms of Use.

These Terms of Use are in addition to any other agreements between you and BIAS, including any agreements that govern your use of BIAS’ products, services, content, tools, and information referred to on BIAS Sites.

BIAS may revise these Terms of Use anytime and without notice by updating this page. We recommend you visit this page periodically to be aware of any changes.

1. Data protection

a. Use of Cookies

BIAS may collect information automatically to track your BIAS Sites navigation through the use of cookies. You have the ability to disable or prevent the placement of these cookies. Please consult the “Help” function in your Internet browser to learn more about how to configure these functions.

b. Newsletter and other e-mailing

BIAS offers a free subscription to a newsletter and other mailings. Subscribers receive information from BIAS regarding international markets on a regular basis.

To provide you with more relevant information, your activity (clicks and requests) on the newsletter and mailers may be analysed.

The subscriber can send an email to in**@bi***********.com to unsubscribe from the mailings at any time.

All information gathered from you in connection with your use of BIAS Sites will be maintained in accordance with BIAS Privacy Policy.

2. User ID and Password

When registering to use BIAS Extranet, you are given a unique user name and password. Please use maximum caution to keep your user name and password confidential and log-off from BIAS Extranet before closing the page to prevent unauthorised access to your information. You are responsible for maintaining the confidentiality of your username and password. You will be responsible for all uses of your username and password whether or not authorised by you. If your username or password is subject to unauthorised access, you agree to immediately inform BIAS.

3. Our Responsibility

We strive to keep BIAS sites and BIAS site content accurate and current.

However, BIAS site content is distributed to you without any warranty of any kind. BIAS and the third-party content providers disclaim any and all warranties.

Information on the BIAS Site is provided on an “as is”, “as available” basis, and to the fullest extent permitted by law we do not give or make any warranty or representation of any kind, whether expressed or implied in respect of such. Your use of BIAS Sites and BIAS site content is at your sole risk.

We do not warrant the accuracy, adequacy, completeness or timeliness of the information, material, products and services or the error-free use of BIAS Sites.

We do not represent or warrant that BIAS Sites will be available or that it will meet your requirements, that access will be uninterrupted, that there will be no delays, failures, errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your computer system. You have sole responsibility for adequate protection and back up of data and/or equipment and for undertaking reasonable and appropriate precautions to scan for computer viruses or other destructive properties.

We make no representations or warranties regarding the accuracy, functionality or performance of any third-party software that may be used in connection with BIAS Sites.

Changes are periodically made to all pages of BIAS Sites, including these Terms of Use, and can occur at any time without notice.

Information or opinions provided by us or through a third-party on BIAS Sites are for information purposes only. Such information or opinions do not constitute any advice or recommendation to buy or sell any securities, investment products or financial instruments. BIAS does not hold itself out as providing any investment, legal, financial or any other professional advice via BIAS Sites.

When making a decision about your investments, you should seek personal advice from your portfolio manager at BIAS, or from a member of the BIAS portfolio management team.

4. Limitation of liability

In no event shall we be liable for any damages, losses or liabilities including without limitation, direct or indirect, special, incidental, consequential damages, losses or liabilities, in connection with your use of BIAS Sites or your reliance on or use or inability to use the information, materials, products and services on BIAS Sites, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if you advise us of the possibility of such damages, losses or expenses.

5. Links to third-party sites or content

Your use of hyperlinks on BIAS Sites is at your own risk. We provide hyperlinks to other locations on the Internet for information and convenience purposes only. No endorsement of third-party websites or content is implied. We are not responsible for the content of any other websites or pages linked to from BIAS Sites. We have not verified the content of any such websites, or pages. It is recommended that you view the linked website’s terms or privacy policy pages to understand how the use of that website may affect you.

We are not responsible for the accuracy, timeliness or the continued availability or the existence of content, hyperlinks, or third-party websites or pages linked to BIAS Sites. BIAS Sites may offer access to news services, market analysis, investment planning tools or other information provided by third-parties on BIAS Sites. No endorsement or approval of any third-parties or their advice, opinions, information, products or services is expressed or implied by any information on BIAS Sites. We do not control, cannot guarantee, and are not responsible for the accuracy, timeliness or even the continued availability or existence of such content.

6. Trademarks and copyright

The compilation, which is the collection, arrangement and assembly of all BIAS site content, is protected by copyright and trademark rights under Bermuda, Cayman and foreign rights.

You may imprint, copy download or temporarily store extracts from BIAS Sites for your personal information or when you use any products and services of BIAS Sites. However, you may not sell, alter or otherwise make any changes to any material that you copied, printed or downloaded from BIAS Sites, including, without limitation, removing any identifying marks or legends from such material. You may not distribute these materials to others. You may not copy or adapt the HTML coding that is used to generate BIAS site content or pages of BIAS Sites.

No one may use BIAS site content on any other website or networked computer environment for any purpose without prior written permission from BIAS.

Any other use is prohibited unless you first request and obtain BIAS written permission.

Content from a third-party provider available on or through BIAS Sites may not be duplicated, distributed, published, transferred, transmitted, copied, altered, sold, used to create derivative works or otherwise misused. You must comply with all terms disclosed to you as required from time to time by any third-party supplier of data or services to BIAS Sites, including but not limited to, where necessary, entering into a direct agreement with such third-party in respect of your use of their data.

You may not use BIAS Sites for any purpose which is unlawful, abusive, libellous, obscene or threatening.

Other than as provided above you may not use or reproduce the BIAS trademark, logo or brand name.

7. Social media

BIAS may from time to time operate channels, pages and accounts on some social media websites to inform, assist and engage with users. Please note the following general terms which relate to our social media channels, pages and accounts:

We may monitor and record comments and posts made on these channels about BIAS so that we can improve our services.

We are not responsible for any information posted on social media websites other than information we have posted ourselves. We do not endorse social media sites themselves, or any information posted on them by third-parties or other users.

BIAS does not offer investment services or products via social media websites, and our operation of such social media channels, pages and accounts does not constitute an offer of any products or services provided by BIAS.

We do not give investment or any other professional advice via social media sites.

When you engage with us via social media websites, your personal data may be stored on those social media site’s servers, which are outside our control and may be located anywhere in the world. Any information posted to such social media sites may be accessed and read by the general public. We will not ask you to share personal, account or security information via social media sites, and you should not post such information on those channels.

We regularly update and monitor our social media accounts and we welcome feedback and ideas submitted via these channels. We may, from time to time, join the conversation on our social media channels, pages and accounts. However, we cannot guarantee to read or reply to all messages sent to official BIAS social media accounts.
